Bixby police say Binney was speeding while attempting to pass another car in a no-passing zone when the vehicle crashed. His teenage daughter Shelby, who wasn’t wearing a seatbelt at the time, was thrown from the vehicle.

Elliott fled the scene before police arrived.

“He left the scene on foot before officers could arrive, and he was able to obtain a second vehicle and fled, and we were able to track that vehicle electronically and found him in Checotah,” Chief Todd Blish said, according to local reports.

Shelby was pronounced dead at the hospital, while the rest of his family members were treated for their injuries at the hospital.

“It tears at your soul when a child is killed in a traffic accident, especially accidents or incidents that are preventable,” said Chief Blish. “It affects that family. It’s a burden they’re going to bear the east of their life, not to mention her friends and family and our officers that responded to the scene. They’re affected by this too.”

FOX23 reports that Elliott and his wife were arguing prior to the crash, and Elliott claimed to lose control after hitting an “oil spot.”

Police also found an unsealed bottle of vodka in the vehicle, which Elliott admitted to taking a swig of before the crash.

Elliott was arrested and charged with leaving the scene of a collision resulting in death, first-degree manslaughter, and passing a vehicle in a no-passing zone. He bonded out of jail on a $102,100 bond.
